This paper addresses the “inefficiency loophole” in the Bell theorem. We examine factorizable stochastic models for the Bell inequalities, where we allow the detection efficiency to depend both on the “hidden” state of the measured system and also its passage through an analyzer. We show that, nevertheless, if the efficiency functions are symmetric between the two wings of the experiment, one can dispense with supplementary assumptions and derive new inequalities that enable the models to be tested even for highly inefficient (...) experiments. This book examines responsibility and luck as these issues arise in tort law, criminal law, and distributive justice. The central question is: whose bad luck is a particular piece of misfortune? Arthur Ripstein argues that there is a general set of principles to be found that clarifies responsibility in those cases where luck is most obviously an issue: accidents, mistakes, emergencies, and failed attempts at crime. In revealing how the problems that arise in tort and criminal law as well (...) as distributive justice invite structurally parallel solutions, the author also shows the deep connection between individual responsibility and social equality. In recent decades it has become increasingly clear that a substantial amount of cognitive work goes on independent of consciousness. The research has been carried out largely under two rubrics, implicit learning and implicit memory. The former has been concerned primarily with the acquisition of knowledge independent of awareness and the latter with the manner in which memories not readily available to conscious recall or recognition play a role in behavior; collectively these operations comprise the essential functions of the cognitive (...) unconscious. This paper reviews the recent history of work on these issues, identifies some of the problems confronting researchers, and introduces a theoretical framework based on principles of evolutionary biology within which to view them. The argument is that the cognitive unconscious, despite its apparent sophistication, is of considerable evolutionary antiquity and antedates conscious cognitive systems by a considerable amount of time. Various entailments of this evolutionary perspective are explored including such issues as phylogeny and ontogeny of implicit processes, the robustness of the implicit functions as displayed by the capacity to resist disruptions from psychological and neurological disorders, the relationship between implicit cognition and intelligence, and individual differences in implicit cognitive abilities. This paper constructs two classes of models for the quantum correlation experiments used to test the Bell-type inequalities, synchronization models and prism models. Both classes employ deterministic hidden variables, satisfy the causal requirements of physical locality, and yield precisely the quantum mechanical statistics. In the synchronization models, the joint probabilities, for each emission, do not factor in the manner of stochastic independence, showing that such factorizability is not required for locality. In the prism models the observables are not random variables (...) over a common space; hence these models throw into question the entire random variables idiom of the literature. The aim of this article is to assess the impact of Big Data technologies for insurance ratemaking, with a special focus on motor products.The first part shows how statistics and insurance mechanisms adopted the same aggregate viewpoint. It made visible regularities that were invisible at the individual level, further supporting the classificatory approach of insurance and the assumption that all members of a class are identical risks. The second part focuses on the reversal of perspective currently occurring in data analysis (...) with predictive analytics, and how this conceptually contradicts the collective basis of insurance. The tremendous volume of data and the personalization promise through accurate individual prediction indeed deeply shakes the homogeneity hypothesis behind pooling. The third part attempts to assess the extent of this shift in motor insurance. Onboard devices that collect continuous driving behavioural data could import this new paradigm into these products. An examination of the current state of research on models with telematics data shows however that the epistemological leap, for now, has not happened. (shrink)

Can a supercompact cardinal κ be Laver indestructible when there is a level-by-level agreement between strong compactness and supercompactness? In this article, we show that if there is a sufficiently large cardinal above κ, then no, it cannot. Conversely, if one weakens the requirement either by demanding less indestructibility, such as requiring only indestructibility by stratified posets, or less level-by-level agreement, such as requiring it only on measure one sets, then yes, it can.

In the contemporary discussion of hidden variable interpretations of quantum mechanics, much attention has been paid to the “no hidden variable” proof contained in an important paper of Kochen and Specker. It is a little noticed fact that Bell published a proof of the same result the preceding year, in his well-known 1966 article, where it is modestly described as a corollary to Gleason's theorem. I WISH to defend the claim that imagining what it would be like to be in "someone else's shoes" can serve to explain that person's actions. This commonsense view has considerable plausibility, but requires clarification to be philosophically defensible; discussions of explanation often assume that understanding requires a theory of the thing understood. If understanding requires a theory, then however much imagining what it would be like to be in another person's situation might sooth one's curiosity, it cannot provide real (...) understanding. I shall argue that imagining oneself in someone else's situation does more than that: it allows actions to be explained without recourse to a theory of human behavior. The resulting explanations are real explanations, not just some reassuring facsimile thereof. (shrink)

The influence of Christianity on the intellectual development of Heidegger can hardly be exaggerated. Heidegger was born in a conservative Catholic family. He first entered university as a student of theology. Even after his formal break with the system of Catholicism, he still considered himself a Christian theologian, and as late as 1935, he still had to struggle with the faith of his birth. The theme of this treatise is the Christian influence on Heidegger as it is displayed in Being and Time. It aims at showing that many important concepts in this opus magnum of Heidegger have their origin in Christian thought. (shrink)

During the late 1970s and early 1980s, population geneticists sought computational solutions to integrate greater numbers of genetic traits into their debates about the ancestral relationships of human groups. At the same time, geneticists’ longstanding assumptions about Jewish communities, especially Ashkenazim, were challenged by a series of social, political, and intellectual developments. In Israel, the entrenched cultural and political dominance of Ashkenazi Jews faced major social upheaval. Meanwhile, to counteract lingering anti-Semitism in Europe and the United States, Arthur Koestler’s (...) The Thirteenth Tribe and Raphael Patai and Jennifer Patai Wing’s The Myth of the Jewish Race argued that Jewish identity was not connected to biological ancestry from the ancient Israelites. Drawing on scientific publications and archived correspondence, this article reconstructs a transnational social history showing how geneticists responded to these shifting claims about Ashkenazi identity and ancestry. Many argued that these claims could be tested using new statistical models, which provided allegedly more “objective” estimates of ancestral gene frequencies and histories of population admixture. However, they simultaneously engaged in heated debates over the relative superiority of competing statistical approaches. These debates reveal how the transnational reverberations of Israeli ethnic politics and Euro-American anti-Semitism affected the development of new calculations for genetic admixture, permanently shifting the assumptions of population genetic research on Jewish populations as well as other human groups. We explore the context and ihe content of Einstein's thinking over these interpretations, emphasizing Einstein's conception of his role not only as a critic of the new quantum theory but also as a guide pointing the way to better physics.

Le présent article revient sur la polémique qui anime les sphères politiques européenne et française depuis les années 1990 autour de la suppression du mot « race » des textes normatifs. Au-delà des enjeux idéologiques que ce débat cristallise, il propose d’élargir la perspective d’analyse à un phénomène plus englobant : la confrontation d’ordres juridiques hétérogènes engagés dans des processus intégratifs : « le droit français et le droit communautaire diffèrent dans leur démarche en matière de lutte contre les discriminations (...) ». Si le droit français « dit » la race, il lui nie une existence normative. A l’inverse, le droit de l’Union en fait un critère distinctif susceptible d’activer des dispositions juridiques liées au principe de non-discrimination. Ce changement de paradigme conduit le juge interne à modifier son approche traditionnelle des droits de l’Homme fondée sur le principe d’égalité. Les décisions du juge et du rapporteur public portent les traces d’aménagements dénominatifs lorsqu’il raisonne dans le cadre d’une approche plus relativiste, légitimant la différence de traitement. A collection of stories by bioethicists writing about their own illnesses displays the importance of microethics. From this perspective, ethics happens not in the application of principles to specific decisions, but rather in the moment-to-moment flow of clinical interaction, as healthcare workers and patients make decisions, especially in their use of language. Microethical issues that are common to multiple stories are described as dense junctures of ethical concern. Three junctures are discussed in detail: conflicts between medical and patient rationalities, issues (...) of how clinicians represent patients, and practices of truth telling. These junctures are illustrated with examples from the bioethicists’ personal stories of treatment. (shrink)

In 1924, Bohr, Kramers and Slater tried to introduce into microphysics conservation principles that hold only on the average. This attempt was abandoned in the light of the Compton-Simon experiment. Since that time, except for a moment of doubt in 1936, it has been thought that the classical conservation laws hold in quantum theory for each individual interaction, in a way that yields the classical exchange-and-balance of momentum familiar from the laws of elastic collisions. It has been thought, that is, (...) that in each individual “collision” what one part of the total system loses in linear momentum another part gains, so as to maintain the same total amount afterwards as before. To those familiar with discussions of the interpretation of quantum theory, however, it will be apparent that the very concepts needed to express this idea of an elastic collision are generally not admitted in the theory. For one needs the idea that both before and after collision the total system has a well-defined value for the conserved quantity and, moreover, that the various component parts of the system have well-defined values for those quantities out of which the conserved one is composed. But in the case of spin, for example, it is customary to say that although total spin may be conserved in certain interactions one cannot attribute values to the separate components of spin because the associated operators do not commute. Moreover, one does not generally refer to the values of quantities except in eigenstates. Hence, in general, one would not refer to the value of the conserved quantity before and after interaction, except for interactions initiated in eigenstates. (shrink)

Although in modern times and clinical settings, we rarely see the old characteristics of tribal shamanism such as deep trances, out-of-body experiences, and soul retrieval, the archetypal dreams, waking visions and active imagination of modern depth psychology represents a liminal zone where ancient and modern shamanism overlaps with analytical psychology. These essays explore the contributors' excursions as healers and therapists into this zone. The contributors describe the many facets shamanism and depth psychology have in common: animal symbolism; recognition of the (...) reality of the collective unconscious; and healing rituals that put therapist and patient in touch with transpersonal powers. By reintroducing the core of shamanism in contemporary form, these essays shape a powerful means of healing that combines the direct contact with the inner psyche one finds in shamanism with the self-reflection and critical awareness of modern consciousness. The essays draw from the contributors' experiences both inside and outside the consulting room, and with cultures that include the Lakota Sioux, and those of the Peruvian Andes and the Hawaiian Islands. The focus is on those aspects of shamanism most useful and relevant to the modern practice of depth psychology. As a result, these explorations bring the young practice of analytical psychology into perspective as part of a much more ancient heritage of shamanistic healing. The historical period of the 18th and early 19th century is usually perceived as the high point of human self-emancipatory optimism. Specifically, the Enlightenment believed that reason would guide humanity from darkness to the light. Ay, there's the rub, so rhymes the Bard of Avon, for wherefrom arriveth the urge to flee the dark? The rationalist propensity to remodel and re-invent the world is testament to a dreary and pessimistic analysis of the human condition. Thus, the Enlightenment made a largely (...) self-content analysis of the natural, traditional and historical condition of humanity which suggested that underneath its emancipatory, rationalist optimism lurks an unspoken perspective on reality that, in the verse of Alexander Pope, on weak wings, from far, pursues [its] flights. In this dissertation, I have called that perspective the horror of existence : the tacit acknowledgment that whatever is naturally and historically presented to the human agent is to be treated with suspicion. Nietzsche even declared such squinty eyes part and parcel of the bad blood of Western metaphysics in its ignoble resentment towards the vitalistic full-bloodedness of existence. Immanuel Kant and Arthur Schopenhauer are the protagonists in the investigation into the pessimistic focal point that looms underneath the Enlightenment s alleged optimism. Three points of inquiry are central to unravelling this pessimism. First, it is to be established that Immanuel Kant the proverbial vanguard of the Aufklärung actually subscribed to a sense of pessimism. Virtuous duty is the code word of Kant s ethics: to act in a fashion in opposition to certain countermoral inclinations. While Kant calls such behavior autonomy in the supposed fullest sense of the term, such autonomy is lacking in appeal in comparison to the pursuit of happiness. If rational morality is left unassisted, it remains in the perennial danger of being ineffective. The human agent is ill-disposed towards the moral law and radically inclined to overturn the moral world order. Accordingly, Kant turns to certain religious tools to bestow a kind of moral education that would augment the appeal of morality without ever making the human agent in any way inclined to moral virtue. At best, the human agent is justified in his/her rational faith to moral progress. In sum, while Kant believed that immanent rationality is the appropriate guide for moral pursuits, it is lacking in appeal to the finite and frail human agent. Second, it is to be shown that Schopenhauer s more overtly pessimistic philosophy is a continuation of a certain philosophical impetus at work in Kant s philosophy. After Schopenhauer questions the irresistible appeal of rationality, he finds that the Kantian recalcitrance to morality could very well be understood as self-justified self-expression of a blind, amoral will. Since even Kant admitted that rationality lacks in appeal to draw humanity in line, why would rationality be the most intimate aspect of noumenal reality? Instead, the human agent is mired in a depravity from which only his/her own frail and quasi-powerless tools can facilitate an escape. Accordingly, an ethics of compassion, a sublime piece of art, a pessimistic religion and proper philosophical insight can facilitate an escape from reality and turn the human agent to blissful nothingness. Third, it is to be shown that Kant and Schopenhauer s specific sense of pessimism is a philosophical translation of a certain theological perspective on the interplay between nature and goodness. Instead of thinking about nature and good as on a continuum, the Protestant Reformation introduced a radical dualism between nature and goodness which requires nature to be radically reformatted. No good is to come from the exercise of nature: works do not justify. Similarly, Kant and Schopenhauer reiterate how a radical change in the normal behavior of the human agent is the only escape from his/her depraved condition. But how do you fuel a quest for health if that which would do the healing is diseased to its core? (shrink)
